Terms of Service
Written in plain language on purpose. If a clause here is doing something you would not expect, we have written it badly.
These cover hiring a vehicle from us and travel we arrange on your behalf. The most important thing on this page is section three — the difference between what we provide ourselves and what we book for you.
Who you are contracting with
Way & Waves, based in Nairobi, Kenya. These terms cover vehicle hire from us and travel arrangements we make on your behalf.
Using this website
By browsing this site you agree to these terms and to our privacy policy, including the cookies it describes. We use a small number of them — analytics, so we know which pages are worth keeping, and spam protection on our forms. There are no advertising cookies and nothing that follows you to other sites.
The privacy policy names each one and explains how to refuse it in your browser if you would prefer.
What we are, and what we are not
We hire out vehicles directly. That part is a contract between you and us.
Everything else — camps, lodges, hotels, flights, boats, guided activities — is provided by third parties. When we book those for you we are acting as your agent, and the contract for that service is between you and the provider, under their terms.
We work with these partners repeatedly and choose them carefully, and we will fight your corner if something goes wrong. But because they are separate businesses, we cannot legally guarantee their performance the way we guarantee our own.
Who may drive
Self-drive hirers need a valid national driving licence held for at least two years, plus an International Driving Permit if the licence is not in English. There is a minimum age, which we will confirm for the vehicle class you want.
Only named drivers on the hire agreement may drive the vehicle. Letting somebody else drive voids the insurance and makes you liable for anything that follows.
Rates, deposits and payment
Rates quoted on this site are indicative starting points. Your actual price is the one in your written quote, and that is what you pay — we do not add charges afterwards.
A refundable deposit is required for vehicle hire, returned once the vehicle is back in the same condition. The amount, the minimum hire period, mileage allowance and fuel arrangement are all stated in your quote before you commit to anything.
Changing or cancelling
Our own cancellation terms are set out in your quote. Tell us as early as you can and we will be reasonable about it.
Third-party bookings follow the provider's cancellation policy, not ours. We will show you those terms before anything is confirmed, so nothing about them is a surprise later.
Looking after the vehicle
The vehicle is checked and photographed with you at handover and again on return. You are responsible for damage beyond fair wear, for fines and penalties incurred while it is with you, and for keeping it secure.
Cross-border travel, and driving in national parks or on routes needing specific clearance, must be agreed with us in advance so insurance and paperwork are actually valid.
Insurance and liability
Every vehicle is insured to the level required by Kenyan law, with the specific cover and excess stated in your hire agreement. We strongly recommend your own travel insurance for anything beyond the vehicle — medical cover, cancellation, and belongings.

Governing law
These terms are governed by the laws of Kenya.
